Work Comp benefits for Undocumented Immigrants
Work Comp benefits for Undocumented Immigrants
Hi everyone! Dustin here from lawatyourside.com.
Today, I want to answer the question of if you're undocumented, can you still collect workers’ compensation benefits?
So you know a lot of undocumented individuals, they might think they're not here legally, they're not supposed to be working, so can they actually collect workers’ comp benefits, and the answer is “Yes, absolutely yes.” In fact, your citizen or you're immigration status is irrelevant for the purposes of workers’ compensation benefit. So if you are undocumented, you're still allowed to collect all the benefits that are entitled to you under the law just as any individual who is documented here in the United States, that means you're allowed to get your temporary disability, you're allowed to get medical treatment, you're allowed to get payments for the amount of permanent disability that you'll end up having. I don’t mean to use these legal terms with you, but just know that you're allowed to get any and all benefits that any other citizen can get under workers’ compensation law.
So hopefully that helps you. Don’t let your immigration status prevent you from filing work comp claim. If you’ve been injured at work, you're entitled to certain benefits, make sure you go and get those. I'll see you in the next video and thanks for watching.
